Arizona Files Lawsuit Against President Biden in Response to Federal Vaccine Vaccine Mandate

US DISTRICT COURT OF ARIZONA- SEPTEMBER 14TH, 2021--The Attorney General of Arizona filed a lawsuit against President Biden and other federal administrators. Biden’s vaccine mandate which requires all businesses with 100 or more employees to get a Covid vaccine. The mandate came after Biden released 2 executive orders last Thursday.

The complaint calls for declaratory judgement declaring the mandate as unconstitutional. Per 28 U.S.C. § 2201. Unlike other Covid vaccine mandate lawsuits, Arizona’s complaint aims to show that the requirements are unconstitutional because they do not apply equally to citizens and non citizens in the US.

Stating in the Complaint:

“Defendants’ differential treatment between immigrants lawfully present in the United States and unauthorized aliens—with vaccination mandates only to apply to the former—is similarly unconstitutional and irrational.

This is the first lawsuit a state has filed against the President or federal government against the vaccine mandate. However several states including Maine and Oregon are facing similar complaints against their state level mandates.
